Terms & Conditions

Last Revised: October 22, 2025
Effective Date: Upon publication of these revised Terms through the Hashtag India website or application.

IMPORTANT: These Terms contain provisions about dispute resolution, individual arbitration, and waiver of class proceedings. Please review Part I, Sections 24–27, carefully. The Hashtag Bites Club rules, including the expiration of Bites and claimed rewards, appear in Part II.

PART I. TERMS OF USE AND SALE

1. Scope, parties, and acceptance
These Terms of Use and Sale (the “Terms”) govern access to and use of Hashtag India’s websites, mobile applications, online ordering features, kiosks where available, and related services (collectively, the “Services”), including orders placed at participating Hashtag India restaurants. Part II sets out additional rules for the Hashtag Bites Club loyalty program (the “Program”).
“Hashtag India,” “we,” “us,” and “our” refer to the Hashtag India brand and the applicable participating restaurant operator as the context requires. The selected restaurant is ordinarily the merchant responsible for accepting and preparing a customer’s order. “You” and “your” refer to the user, customer, or Program member.

By using the Services, registering for the Program, or placing an order after the applicable Terms have been made available, you agree to these Terms. If you disagree, do not use the affected Services. Terms displayed with a particular offer, order channel, or promotional benefit also apply to that feature; more specific offer terms control the offer where they conflict with these Terms, subject to applicable law.

We may revise these Terms. Changes take effect when the updated version is published or on another date stated in the revision. We will provide notice of material changes where required by law. Changes will not retroactively alter a completed transaction except as permitted by applicable law and the terms applicable to that transaction.

2. Privacy policy
Our handling of personal information is described in the Hashtag India Privacy Policy: https://www.hashtagindia.com/privacy-policy. Use of the Services is also subject to that policy where applicable.

3. Customer accounts
Some features require an account. You agree to provide accurate contact, payment, and registration information and keep it updated. You are responsible for protecting your login details and notifying us promptly if you suspect unauthorized access. Accounts and associated loyalty benefits are for personal use and may not be sold or transferred unless expressly allowed.

4. Age eligibility
The Services are intended for adults. Minors may use the Services only with parental or legal guardian consent and supervision where permitted by law. A parent or guardian remains responsible for a minor's authorized use.

5. Electronic orders and notices
Orders, receipts, disclosures, and customer notices may be provided electronically. Placing an order through a checkout that displays the applicable terms indicates acceptance of that order and those presented terms. Any records retained of acceptance, purchase, and fulfillment will be handled in accordance with applicable law and our Privacy Policy.

6. Communications and preferences
We may send order confirmations, status updates, receipts, loyalty information, and account alerts through available channels. Promotional email and SMS communications will be sent only as permitted by applicable law and any required consent or preference settings. You may opt out of promotional emails using an unsubscribe link and promotional SMS messages by replying STOP to the sending number. Changes to your preferences do not necessarily stop transactional or legally permitted account communications. Push-notification preferences may be managed in your device or app settings. A request to stop promotional communications will not be treated as cancellation of Program membership.

7. Permitted use and intellectual property
Content, trademarks, imagery, menus, and software associated with the Services belong to Hashtag India or the relevant rights holders. You receive a limited, personal, noncommercial right to use the Services. You may not reproduce, misuse, sell, scrape, interfere with, or exploit our content or systems without authorization.

8. Prohibited conduct
You may not use the Services for unlawful, fraudulent, abusive, deceptive, or unauthorized activity, including false transactions, duplicate reward claims, unauthorized access, malicious software, fraudulent refunds, or other misuse of offers or accounts. We may investigate, limit, suspend, or terminate access where misuse is identified, subject to applicable law.

9. Customer submissions
If the Services allow reviews, messages, photographs, suggestions, or other submissions, you represent that you have the rights necessary to submit them. You grant us permission to process and use such materials for operating, improving, and supporting the Services in accordance with applicable law and our Privacy Policy. We may moderate or remove material that violates these Terms.

10. Payment methods
Accepted payment methods may vary by restaurant and order channel. By supplying a payment method, you represent that you are authorized to use it. A temporary payment authorization may appear when supported by the payment processor. The Services do not create a bank or deposit account.

11. Payment authorization and processing
By placing an order, you authorize the applicable participating restaurant and its payment service providers to charge the amount disclosed at checkout, including products, taxes, fees, delivery charges, tips, and other displayed amounts, less eligible discounts or credits. Payments may be processed by third-party providers subject to their applicable terms. Failed or reversed transactions may require resolution before an order can be accepted or fulfilled.

12. Order acceptance and preparation
An order placed through the Services is a request to purchase from the selected participating Hashtag India restaurant. The restaurant may accept or decline the order based on availability and operating conditions. Orders, menu items, and fulfillment options may vary by location. Customers should verify the restaurant, fulfillment mode, order details, and total price before submitting an order.

13. Order changes and cancellations
Orders may enter preparation shortly after acceptance. Requests to cancel or change an order are subject to whether preparation has begun, whether cancellation or editing is supported, the participating restaurant's decision, and applicable law. If a cancellation is approved, any refund or credit will be governed by the refund terms below. No provision limits remedies required by law.

14. Pickup orders
Customers must collect pickup orders from the restaurant selected at checkout and within the pickup window communicated for the order. The restaurant may be unable to preserve food quality or safety after a prolonged collection delay. Uncollected orders that were prepared and made available may be ineligible for a discretionary refund, subject to applicable law and the circumstances of the order.

15. Delivery orders
Delivery is available only where offered. A participating restaurant or delivery service provider may fulfill the order. Quoted delivery times are estimates rather than guarantees. Customers must provide complete and accurate delivery information, including unit and access instructions where relevant, and be available to receive the order. We may share order and delivery information with providers as necessary to fulfill delivery, subject to our Privacy Policy. Problems with fulfillment are handled under the applicable order support and refund process.

16. Prices, fees, and menu availability
Prices and menu availability may differ by restaurant and sales channel. Taxes, service fees, tips, and delivery charges, when applicable, are displayed in the ordering flow. We may correct pricing or menu errors and address affected orders in accordance with applicable law. Specific coupons and promotions may have eligibility requirements, exclusions, and expiration dates that are shown with the relevant offer.

17. Returns, refunds, and service issues
Because food is perishable, ordinary returns are generally not accepted. If an order is incorrect, missing, damaged, not prepared, or not delivered as agreed, contact the participating restaurant or the support contact listed below promptly. Refunds, replacements, and credits depend on the circumstances, the order channel, and applicable law. An approved refund will ordinarily be processed through the original payment channel; timing depends on the applicable processor or card issuer. This section does not waive statutory consumer rights.

18. Failed transactions
If a payment fails, an order may be declined or require another payment method. Where an accepted order has an unresolved payment balance, we may contact you to resolve the balance using lawful means. Bank or payment-provider charges are controlled by the applicable provider's terms.

19. Payment disputes and chargebacks
If you do not recognize a charge or encounter an order issue, contact the participating restaurant or Hashtag India support so the issue can be investigated. You retain any rights to dispute a card transaction through your payment provider under applicable law and network rules. We may provide lawful order records and fulfillment information to the payment provider in response to a dispute. Knowingly submitting fraudulent claims or using payment disputes to abuse the Services may result in restrictions or other lawful remedies.

20. Transaction records
Subject to applicable law and our Privacy Policy, we or our service providers may maintain order confirmations, payment events, acceptance records, preparation and fulfillment statuses, customer communications, and related timestamps to operate the Services, resolve support requests, and investigate payment disputes.

21. Third-party services and links
The Services may link to providers we do not control. Third-party ordering, payment, delivery, or external websites may apply separate terms and privacy policies. We are not responsible for their independent services except where applicable law provides otherwise.

22. App and device updates
The app or Services may require updates for continued operation. Your mobile or internet provider may charge applicable data fees. Where Apple or another distribution platform provides the app, its relevant platform terms may also apply.

23. Service availability and warranty disclaimers
We aim to provide accurate information and dependable service, but availability, menus, rewards, pricing displays, and delivery integrations can be affected by errors or interruptions. To the extent permitted by applicable law, the Services are provided without a guarantee of continuous or error-free operation. Nothing in these Terms removes a warranty or consumer protection that cannot lawfully be excluded.

24. Disclaimer of warranties and limitation of liability
Hashtag India seeks to keep its Services accurate and available, but website and app functions may occasionally be interrupted, unavailable, delayed, or inaccurate. To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis without warranties that can lawfully be excluded.
To the fullest extent permitted by applicable law, Hashtag India and the applicable participating restaurant shall not be liable for indirect, incidental, special, or consequential damages arising solely from access to or use of the Services. This limitation does not exclude or restrict liability that cannot legally be limited, including any applicable rights relating to fraud, intentional misconduct, personal injury, or statutory consumer remedies. No fixed monetary liability cap is adopted in this revision.

25. Indemnification
To the extent permitted by applicable law, you agree to be responsible for reasonable losses, liabilities, and expenses incurred by Hashtag India or a participating restaurant that result directly from your intentional unlawful conduct, knowing fraud, or material misuse of the Services in breach of these Terms. This clause does not require you to indemnify any party for its own misconduct or eliminate legal defenses available to you.

26. Dispute resolution and individual arbitration

Informal resolution. For a concern about an order, payment, account, or Program benefit, you may contact the participating restaurant or the customer contact identified in Section 28. Before commencing arbitration, the party bringing a dispute shall give the other party written notice describing the dispute and the relief sought and allow thirty (30) days to attempt a good-faith resolution. This process does not delay or impair the exercise of a non-waivable legal right or the timely filing of a claim where applicable law requires otherwise.

Agreement to arbitrate. Except for qualifying individual small-claims matters and disputes that applicable law does not permit to be arbitrated, you and Hashtag India agree that claims arising out of or relating to these Terms, the Services, qualifying purchases, or the Program will be resolved through binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, or by another appropriate administrator if AAA is unavailable or the parties agree. Arbitration fees and procedures will be governed by the applicable consumer rules and mandatory law. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate to the extent applicable.

Individual claims and court exceptions. Either party may bring a qualifying individual claim in small-claims court instead of arbitration. An arbitrator may grant the relief available under applicable law for an individual claim. Judgment on an arbitral award may be entered in a court with proper jurisdiction.

Class action and jury trial waiver. To the fullest extent permitted by law, you and Hashtag India agree to bring disputes in an individual capacity and not as a named plaintiff or member of a class, collective, or representative proceeding. Where a dispute is properly submitted to binding arbitration, the parties waive trial before a court or jury for that dispute. If a prohibition against representative proceedings is not enforceable for a specific claim, the treatment of that claim will be governed by applicable law, and other provisions will remain effective to the extent they can be lawfully enforced.

27. Texas governing law and jurisdiction
These Terms, the Services, and the Hashtag Bites Club Program Rules shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-laws principles, except where applicable federal law or non-waivable consumer protection laws provide otherwise.
Subject to the enforceable arbitration agreement, small-claims procedures, and any mandatory legal requirements, a court proceeding arising out of or relating to these Terms shall be filed in a state or federal court of competent jurisdiction located in Texas, to the extent such a venue requirement is permitted by law. The applicable court must independently have subject-matter and personal jurisdiction.

28. Notices, support, and contact information
We may communicate with you regarding these Terms, transactions, and the Program using the email address or other contact details associated with your account, through notices presented on the Services, or by other methods permitted by law.
For questions about an order, contact the participating restaurant identified in the order confirmation. For questions or notices about the website, mobile app, or loyalty program, contact hashtagindia.merchant[at]froogal.ai. For formal legal notices, please use the contact information identified on the currently published Hashtag India website or request the appropriate legal-notice address through this email before service. A brand-level mailing address may be added once the contracting entity confirms it.

29. Severability, assignment, waiver, and survival
If any provision of these Terms is determined to be invalid or unenforceable, it will be limited or severed to the extent necessary, and the remaining provisions will continue in effect where permitted by law. Our failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
Hashtag India may assign its rights and obligations under these Terms in connection with a legitimate business transfer or reorganization, subject to applicable law. You may not transfer your account or contractual rights without our written approval where such approval is lawfully required. Provisions that by their nature should continue after termination, including payment obligations, intellectual property rights, dispute resolution, and governing law, will survive to the extent permitted by law.

30. Entire agreement
These Terms, the Privacy Policy, the Hashtag Bites Club Program Rules below, and terms clearly applicable to specific promotions or transactions together govern the relevant aspects of the Services. If a particular promotion has different conditions, those conditions control for that promotion where lawfully permitted.

PART II. HASHTAG BITES CLUB LOYALTY PROGRAM RULES

1. Program overview
Hashtag Bites Club (the “Program”) is the loyalty and rewards program offered through participating Hashtag India restaurants and approved digital channels. Members may earn loyalty units referred to as Bites (also called “points”), claim eligible rewards, and receive membership benefits. Availability may vary by participating location, purchase channel, item, and offer terms. Membership is free where offered. Program participation is voluntary. The Program is designed for individual consumers and may not be used for business resale or unauthorized commercial accumulation of rewards.

2. Membership eligibility and account identification
Eligible individuals may enroll using approved methods on the Hashtag India website, app, or at participating restaurants. A member should maintain accurate account information and may be asked to use a registered phone number or signed-in account to associate qualifying purchases and Program benefits with that membership. Members may not sell or transfer Program accounts, Bites, or claimed rewards unless a particular offer expressly permits it.

3. Membership tiers and published earning rates
The Hashtag India Rewards Program offers three membership levels: Member, VIP, and Elite. The Member tier is free to join and earns 10 Bites for every $1 spent on qualifying purchases. Members who spend $1,000 annually on qualifying purchases qualify for VIP status and earn 11 Bites per $1 spent, while members who spend $3,000 annually qualify for Elite status and earn 12 Bites per $1 spent.

Tier status, calculation periods, eligible qualifying spend, effective upgrade dates, and available benefits are subject to the Program configuration and applicable terms. A “year” for tier-qualification purposes means the measurement period specified in the member’s account or applicable Program disclosure. Renewal, upgrade, and downgrade arrangements follow the rules presented for the membership tier; tier status may be adjusted for canceled or refunded purchases. If a member receives a different offer-specific earning rate, the displayed offer rules control for that transaction.

4. Qualifying purchases and points earning
A qualifying purchase is an eligible Hashtag India transaction at a participating restaurant through an approved channel and properly associated with the member's account. Online and app purchases may require members to be signed in. Dine-in transactions may require the registered phone number or another permitted method of identifying the member. Unless otherwise stated in an eligible offer, Bites are calculated on the portion of the eligible item purchase price that qualifies for points under the ordering system. Taxes, tips, delivery and service fees, refunded amounts, discounts and amounts paid with a reward are not represented as earning Bites unless the applicable checkout or offer explicitly provides otherwise. Third-party marketplace, catering, gift-card, or other purchase types earn Bites only where expressly supported and disclosed for the participating location.
Points earned from purchases that are canceled, refunded, reversed, duplicated, or found ineligible may be adjusted or reversed. Bites have no cash value and cannot be exchanged for cash.

5. Published reward levels
Members can redeem their accumulated Bites for rewards at participating Hashtag India locations, including a free dessert for 750 Bites, a free 8 oz vegetarian or chicken appetizer for 1,500 Bites, a free vegetarian or chicken biryani for 2,000 Bites, and a free one-piece vegetarian or chicken Mandi for 2,500 Bites. Claimed rewards can be redeemed with the member’s next qualifying purchase, subject to applicable item eligibility, availability, minimum purchase requirements, redemption limits, and participating locations, as specified in the individual reward terms and conditions.

6. Claiming versus redeeming a reward
Claiming a reward is the action of converting or applying eligible Bites to obtain an available reward in the member's loyalty account. A claimed reward may remain available for a later qualifying transaction until it is redeemed or expires. Redeeming a reward is the later action of using that claimed reward against an eligible order in accordance with the displayed conditions. Claiming a reward alone does not mean that an item has been ordered, collected, delivered, or consumed.

7. Expiration of unused Bites: 365 calendar days
Unused Bites expire 365 calendar days from the date on which they are earned. Bites that have not been used to claim an eligible reward before their applicable expiration date will expire, be removed from the available balance, and no longer be available for claiming rewards, subject to applicable law. Earning additional Bites or placing a new order does not, by itself, restart the expiration period of previously earned Bites.

Application to existing unused Bites. The 365-day expiration policy also applies to all unused Bites earned before the effective date of this updated policy. For those existing Bites, the 365-day period is calculated from the original date each Bite was earned, not the date the policy is published. Bites that have already reached or exceeded 365 days of age when this policy takes effect are subject to expiration under this rule. Hashtag India will provide any advance notice or transitional treatment required by applicable law, and may announce an additional grace period through the Services or a member notice.

8. Expiration of claimed rewards: 60 calendar days
Any reward claimed by a member expires 60 calendar days from the date it is claimed if it has not been redeemed. Once that period ends, the unused claimed reward is no longer valid and cannot be applied to a future order, subject to applicable law. The 60-day period is measured from the reward claim date, not from the date on which the original Bites were earned. A successful claim creates a distinct claimed reward with its own expiration period.
This rule applies to rewards that require a member to take an affirmative claim action in the Program, whether claimed using Bites or claimed through another eligible reward mechanism. Offers issued automatically without a member’s claim action, such as certain signup, referral, birthday, or other promotional discounts, may carry separately disclosed expiration dates and are not treated as “claimed rewards” solely because they appear in the account. For rewards claimed before the effective date of this revision, any required notification or transitional treatment will be provided before the new expiration policy is enforced against them.

9. Bites deducted for a claimed reward
When a member claims a reward using Bites, the number of Bites required for that reward is deducted from the member’s available Bites balance. The claimed reward is then tracked separately from unused Bites. Claiming a reward is not the same as redeeming it against an order. If a claimed reward expires unused, it cannot be applied to an order. Whether any previously deducted Bites may be restored after expiration, cancellation, or correction depends on the expressly disclosed reward rules and applicable law; restoration is not automatic merely because a reward was unused.

10. Expiration reminders and account visibility
Hashtag India may provide expiration information or reminders by app, website, email, SMS, or other authorized channels where supported. Members should review the expiration date shown for their Bites and claimed rewards in their accounts. Reminder delivery is not guaranteed, and the absence of a reminder does not by itself extend a correctly disclosed expiration deadline, subject to applicable law. The Program may display expiration dates, where supported. Members may contact support if the displayed date or point balance appears incorrect.

11. Ways to use rewards
As advertised on the Hashtag India Rewards page, reward redemption may be available through online orders, app orders, and eligible dine-in transactions. Redemption is subject to participating-location support, reward conditions, eligible products, available inventory, and the checkout or in-store validation method. Members must meet the conditions displayed for the particular reward. A reward may not be redeemed for cash and generally cannot be transferred to another account.

12. Signup, birthday, referral, and tier benefits
Hashtag India's published Rewards page currently describes a US $10 signup offer on a qualifying online purchase of US $30. It also describes Member, VIP, and Elite birthday benefits, tier welcome benefits, special pricing, and other perks. Eligibility, value, minimum spend, expiration, order channel, and other restrictions are controlled by the specific benefit's disclosed terms. These offers are not automatically interchangeable with rewards claimed using Bites.
Where a marketing description differs from the offer made available to a member, the offer shown with the benefit at issuance and redemption governs the benefit, subject to applicable law. Hashtag India may correct marketing descriptions to match the applicable tier benefit.

13. Missing Bites requests
If a qualifying purchase does not appear in the member's account, the member may contact the participating restaurant or use a missing-points request feature if offered in the app or website. The Program may require transaction verification, such as purchase date, location, receipt number, order number, amount, and associated account information. Requests may be declined or adjusted if the transaction cannot be verified, was already credited, or is ineligible. A missing-Bites request does not guarantee an adjustment or that an excluded transaction will become eligible.

14. Promotional and bonus Bites
Hashtag India may offer bonus Bites, promotional offers, referral benefits, challenges, or targeted campaigns from time to time. Each promotion may include its own qualifying activity, eligibility, earning amount, activation requirements, expiration, redemption limit, and participation restrictions. A promotion may be withdrawn or corrected, subject to applicable law and properly disclosed offer terms.

15. Fraud, misuse, and account adjustments
Hashtag India may investigate and correct duplicate accounts, fraudulent transactions, incorrect points issuance, manipulated orders, invalid missing-points requests, abusive redemptions, or technical errors. Where a claim is determined to be invalid, related points and benefits may be adjusted or reversed as permitted by law.

16. Program availability and changes
The Program, its tiers, earning rates, eligible purchases, benefits, rewards, and participation by particular locations may change in accordance with applicable law. Any materially adverse changes affecting previously earned or claimed benefits should be evaluated for customer notice, the applicable offer terms, and legal requirements before being applied.

17. Membership cancellation
Members may request cancellation through approved account or customer-support processes. Canceling membership ends future participation and may affect unused Bites and unredeemed rewards, subject to previously disclosed terms and applicable law. Unused Bites and unredeemed claimed rewards may be forfeited when membership is canceled, except as provided by applicable law or expressly disclosed offer terms.

18. Communications and privacy
Personal information is handled in accordance with the Hashtag India Privacy Policy. Promotional email and SMS communications are subject to opt-in and opt-out rules. Separately from promotional messaging, the Program may send account, transaction, reward, and expiration communications when permitted by law and applicable communication preferences.

19. Disputes and legal provisions
Disputes about the Program are governed by Part I, including the dispute resolution provisions in Section 26 and Texas governing law and jurisdiction in Section 27, subject to applicable law. No separate or conflicting Program-specific arbitration, governing-state, or monetary liability-cap provisions apply.

20. Program assistance
Questions regarding Bites, claimed rewards, redemption, account activity, or membership should be directed to the participating Hashtag India restaurant or hashtagindia.merchant[at]froogal.ai, or by using an available support channel in the Services.
